Affiliate/partner Policy

We collaborate with a number of other brand partners who sell products through the moda app or provide products, services, or the ability to earn Clubcard points (Clubcard Reward Partners). We only give our retail partners the personal information they need to give you the services you've asked for.

We only give our partners the personal information they need to do their jobs, and they can only use it for the things we've agreed upon.

To better understand your purchases and interactions with us, we may also combine data from service providers with data held by The Moda.

This agreement has all of the terms and conditions that apply to a transaction between an individual and an entity.

participation in the Associates Program at Moda (the "Program"). The Moda Inc. or any of our affiliates are referred to as "we," "us," or "our" in this Agreement. "We" refers to our parent or group companies, as well as our successors and assigns, and "you" refers to the applicant. "The Moda Site" means, collectively, the themoda.com website. "Your site" refers to the website from which you will link to The Moda Site (and which you will identify in your program). Except for our obligation to pay referral fees under the CAP Code, which may only be performed by governing bodies, we may have any of our obligations under this Agreement fulfilled on our behalf by any of our Affiliates (defined below).

Term of the Agreement

The term of this Agreement will begin upon our acceptance of your Program Application and will end when terminated by either party. Either you or we may terminate this Agreement at any time, with or without cause, by giving the other party written notice of termination. Upon the termination of this Agreement for any reason, you will immediately cease use of, and remove from your site, all links to the Themoda Site or App,, and all of our trademarks, trade dress, and logos, and all other materials provided by or on behalf of us to you pursuant hereto or in connection with the Program. You are eligible to earn referral fees only on sales of Qualifying Products that occur during the term, and referral fees earned through the date of termination will remain payable only if the related orders are not canceled or returned. We may withhold your final payment for a reasonable time to ensure that the correct amount is paid.

Compliance with Laws

As a condition to your participation in the Program, you agree that while you are a Program participant you will comply with all laws, ordinances, rules, regulations, orders, licenses, permits, judgments, decisions or other requirements of any governmental authority that has jurisdiction over you, whether those laws, etc. are now in effect or later come into effect during the time you are a Program participant. Without limiting the foregoing obligation, you agree that as a condition of your participation in the Program you will comply with all applicable laws(federal, state or otherwise) that govern marketing email and all other anti-spam laws.

Effect of Termination:

Upon termination of this Agreement by either side you will cease to be an affiliate/partner and shall remove all links to the themoda site as detailed above and non-removal of links and use of all or any of our trademark, trade dress, logos and price are treated as illegal crawling and infringement of our Trademark.
